Malcolm Bolivar, in association with AV Press (dba for Aleen Ventures, LLC) will be conducting this competition. For the purposes of these Terms and Conditions, "AV Press" refers to Malcolm Bolivar and Aleen Ventures, LLC. The "Prize" refers to one (1) JBL Flip 6 portable speaker valued at $149.95 retail price with customer Dark November Graphic applied.

• By entering the competition you agree to be bound by these terms and conditions. All entries must be received by 11 PM Eastern Time on June 23, 2024. Winners must be residents of the United States with a valid mailing address. One (1) winner will be selected at random by AV Press on June 29, 2024 and the winner will be notified via email no later than July 3rd, 2024.

• This competition by AV Press with entry via the terms below are open only to residents of the United States with valid mailing addresses. One (1) winner will be chosen at random from all entrants.

• In order to qualify winners must:

  • Purchase a copy of the Dark November Novel at a Book Festival or via Amazon in eBook or Print version.

  • Write a review on Amazon for the book.

  • Complete the registration form linked from this page and provide a valid mailing address, email address, and link to the review. All reviews will be verified and validated prior to entrants being qualified for a chance to win. Your review must be publicly available and active on the date of the random selection

• Entrants must be over 18 years old on the date of their entry.

• Amazon, JBL, and the Book Festivals are not in any way affiliated or involved in the competition.

• Only one entry per person per competition will be accepted.

• The Prize will be awarded to a randomly selected winner who has entered using the form on this page, using a random number generator. AV Press will not be held liable if the named prize becomes unavailable or cannot be fulfilled.

• AV Press will not be held liable for any failure of receipt of entries. AV Press takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.

• To the extent permitted by applicable law, AV Press’ liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.

• To the extent permitted by applicable law, AV Press shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and AV Press and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

• Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, AV Press reserves the right to substitute that prize for a prize of equal or higher value.

• The name, address, email address and phone number of the winner must be provided to AV Press (through the registration form) and will be used to enable fulfilment of the Prize and communicate to entrants as needed. Once the winner is selected, the winner will be notified by email to confirm their shipping address. If they do not respond and acknowledge that they have won within five (5) days of the email notification being sent, AV Press will randomly select, using the same method, from the remaining people who registered for a chance to win and meet the requirements set forth in these terms and conditions.

• In the event of unforeseen circumstances beyond AV Press’ reasonable control, AV Press reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.

• AV Press’ decision is final. No correspondence will be entered into.

• The winner’s name may be posted on this website (MalcolmBolivar.com) after the winner has been selected.

• AV Press will ship the prize via an insured shipment requiring signature release. Inability to sign for or receive the shipment along with any loss of the item after the delivery is not the liability of AV Press. AV Press will maintain shipping and signature verification for sixty (60) days after the prize has been delivered to the winner.

• AV Press provides no warranty for the prize. The prize will ship in the box it was received from JBL and will be opened and tested by AV Press to make sure it is functioning properly and the Dark November design was properly applied. Registration of the product with JBL and any warranty claims are the responsibility of the winner and will not be supported or guaranteed by AV Press.
